DUI and Criminal Defense

A Gainesville Police Department officer responded to a call for backup requested by another officer. The responding officer conducted a traffic stop and noted multiple indicators of impairment when he made contact with the driver. The driver had bloodshot, watery eyes. There was a strong odor of an alcoholic beverage emanating from the driver’s person. The driver openly admitted to drinking several drinks earlier in the evening and was wearing a wristband that is typically given at the entrance to bars.

The driver consented to field sobriety exercises and performed poorly. The driver was arrested for DUI. During the search of the driver’s vehicle a 1.75 liter bottle of vodka was located in the back seat and was only one-third full. The driver agreed to provide breath samples and blew a 0.192g/210L and 0.194g/210L.

The driver retained Meldon Law and we were able to negotiate with the State Attorney’s office. The State originally offered a plea deal of DUI below .15 but we were able to negotiate the charges down to reckless driving with alcohol.
