Gainesville, Florida Driver Admitted Into DUI Deferral Program, DUI Reduced to Reckless Driving Charge
A policeman initiated a traffic stop on a vehicle that was stopped beyond the stop bar at a traffic signal for Newberry Road, Gainesville, Florida. The policeman had witnessed a truck driving the near the vehicle use evasive measures to avoid striking the vehicle at which time the vehicle got further into the outside lane of Newberry but remained stopped and did not complete the entrance on to Newberry Road which forced the policeman to come to a complete stop.
During the stop, the officer noticed a strong odor of alcohol and after being asked the driver admitted to consuming “two or three beers” prior to driving. The driver agreed to perform Standardized Field Sobriety Exercises, but stumbled on the way out of the vehicle and was unable to successfully complete any of the exercises. The driver was arrested for DUI and brought to the Alachua County Jail where he submitted to a breath test and twice blew .174g/210L and .164g/210L. (Date of Arrest: December 21,2012) The driver was admitted into the DUI Deferral Program. If the driver completes this program successfully, his DUI will be reduced by the State Attorney to a Reckless Driving charge.
